Billow is owned and operated by Fanattik Tech Labs LLC, a limited liability company registered in the State of Delaware, United States ("Company," "we," "us," or "our"). References to "Billow," "the app," or "the Services" mean the Billow mobile application, website, API, and all related products and features.

1. Scope & Acceptance

This Privacy Policy explains how Fanattik Tech Labs LLC collects, uses, stores, discloses, and protects information obtained through the Services. By downloading, installing, creating an account, or otherwise accessing the Services, you acknowledge that you have read, understood, and agree to the practices described in this Privacy Policy. If you do not agree, do not use the Services.

2. Governing Jurisdiction & Company Information

The Services are owned and operated by Fanattik Tech Labs LLC, a limited liability company registered in the State of Delaware, United States. All disputes or claims arising out of or relating to the collection, use, or protection of personal data shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict-of-law principles. 3. Information We Collect

A. Information You Provide

  • Account Details: Name, email address, phone number, and any profile information you choose to add.
  • Location Context: ZIP codes or towns you subscribe to for local content.
  • User Content: Any content you post, such as chats, recommendations, reviews, images, announcements, and other user-generated content.
  • Business Information: Business listings, profile details, service descriptions, pricing, and other information provided by business users.
  • Payment Information: Subscription and credit purchase transactions are processed by PayPal and the Apple App Store / Google Play Store. We do not store your full payment card details. We receive limited transactional data (e.g., order IDs, transaction status) necessary to confirm and fulfill your purchase. See Section 10 for full details on subscription billing.

B. Information Collected Automatically

  • Device and Usage Data: Device type, operating system, app version, IP address, access times, pages viewed, and crash logs.
  • Call & Interaction Logs: If you or your business uses the Rudy AI Voice Agent feature, call records including duration, AI-generated transcripts, intent classification, and booking outcomes may be stored. See Section 6 for the full Rudy AI disclosure.
  • Feed Interaction Data: When you view or interact with the Town Feed, we record which cards were shown, tapped, and whether a booking resulted. This data is used to personalize your experience and improve our AI models.
  • Cookies and Similar Technologies: We use cookies and web storage to operate and improve our website.

C. Information From Third Parties

  • Third-Party Content: Content about you that other users may share in chats, reviews, or recommendations.
  • Google Business Profile & Maps: We may ingest publicly available business data from third-party directories to seed the platform. Such data is publicly available. If you are a business owner and believe data about you is inaccurate, you may request correction at connect@billowai.net.
  • Service Providers: Partners who support our hosting, analytics, security, payment processing, telephony, and AI inference functions.

4. How We Use Your Information

We use the information we collect to:

  • Provide, operate, maintain, secure, and improve the Services.
  • Power AI features including Rudy AI (voice, chat, content generation, recommendations, and search) and to monitor for abuse.
  • Process subscription payments, credit purchases, and manage your billing relationship.
  • Build and improve our internal AI training data corpus (the "Billow Brain"), including labeled interaction data from Rudy calls, broadcast negotiations, feed engagement, and completed job records. This data is used to improve our models and may be used to train proprietary AI systems. Data used for training is anonymized or pseudonymized to the extent practicable.
  • Communicate with you regarding service updates, security alerts, billing, and — where permitted — marketing messages.
  • Enforce our Terms of Service, protect the safety of our users and the public, and comply with legal obligations.

5. AI-Generated Content — Important Disclaimer

Important: AI outputs produced by Billow (including but not limited to announcements, captions, content ideas, business profile summaries, pricing suggestions, and Rudy AI responses) are generated automatically and may be inaccurate, incomplete, or misleading. Fanattik Tech Labs LLC makes no warranty, express or implied, as to the accuracy, reliability, or fitness for any purpose of any AI-generated content. All AI-generated content must be independently reviewed and verified by the user before being published, acted upon, or relied upon. Fanattik Tech Labs LLC is not responsible for any business loss, reputational harm, regulatory violation, legal liability, or any other consequence arising from the publication or use of AI-generated content without adequate review. You publish AI-generated content entirely at your own risk.

Specifically:

  • Announcements and Promotional Copy: AI-generated promotional content may contain pricing, service descriptions, or claims that do not accurately reflect your actual offerings. You are solely responsible for ensuring all published content is truthful, compliant with applicable advertising laws (including FTC guidelines), and does not constitute false or misleading advertising.
  • Business Profile Summaries: AI-generated or AI-inferred business profile information may be incorrect. You are responsible for reviewing and correcting your profile.
  • Pricing Guidance: Any AI-generated pricing recommendations are informational only and do not constitute professional pricing, legal, or financial advice.

6. Rudy AI Voice Agent — Important Disclosure

The Rudy AI Voice Agent ("Rudy") is an automated AI telephony feature that answers inbound calls, responds to caller inquiries, and may attempt to book appointments on behalf of a business owner who has activated this feature. By activating Rudy or by calling a Rudy-enabled business number, you acknowledge and agree to the following:
  • Automated System: Rudy is a fully automated AI system. You are not speaking with a human employee or representative of Fanattik Tech Labs LLC. You are interacting with an AI model operating based on the business owner's configured profile information.
  • Call Recording & Transcription: Calls handled by Rudy are recorded and transcribed. By calling a Rudy-enabled phone number, you consent to being recorded and transcribed. Business owners are responsible for complying with all applicable call recording and wiretapping laws in their jurisdiction (including one-party and two-party consent states) before activating Rudy.
  • No Liability for Call Outcomes: Fanattik Tech Labs LLC is not responsible for the accuracy of any information Rudy conveys, any booking or appointment made during a Rudy call, any missed call, failed booking, incorrect pricing or availability communicated by Rudy, or any action taken or not taken in reliance on a Rudy call. All commitments arising from a Rudy call are solely between the business owner and the caller. Fanattik Tech Labs LLC is not a party to any such arrangement.
  • Business Owner Responsibility: The business owner who activates Rudy is solely responsible for ensuring the accuracy of the information in their business profile (services, pricing, hours, availability) and for any consequences arising from Rudy's AI-generated responses. Fanattik Tech Labs LLC provides Rudy as a technology tool only.
  • AI Limitations: Rudy may misunderstand callers, provide incorrect information, fail to connect, drop calls, or otherwise malfunction. Fanattik Tech Labs LLC makes no warranty that Rudy will be available, accurate, or error-free at any time.

7. Sharing & Disclosure

We do not sell your personal information. We may share your information with:

  • Service Providers: Third-party vendors who perform services on our behalf, including cloud hosting (Supabase), AI inference (Google Gemini, Vapi.ai), telephony (Twilio), payment processing (PayPal, Apple, Google), and analytics. These providers are bound by data processing agreements and may not use your data for their own purposes.
  • Other Users: To the extent you post or interact in public or semi-public areas of the Services (e.g., your public business profile, Town Feed posts, reviews).
  • AI Training Partners: Anonymized or aggregated interaction data may be used with AI infrastructure providers (e.g., Google) to train and improve AI models.
  • Legal & Law Enforcement: When legally required, or to protect the rights, safety, and property of Billow, our users, or the public.
  • Business Transfers: In connection with a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets, your information may be transferred as part of that transaction.

If a "sale" or "share" under your jurisdiction's law includes certain analytics or advertising technologies, we will honor your right to opt-out.

8. Data Retention

We retain your personal data for as long as it is necessary to provide the Services, comply with our legal obligations, resolve disputes, and enforce our agreements. Call transcripts, agent decision logs, and feed interaction data may be retained indefinitely as part of our AI training corpus and are not subject to routine deletion. If you delete your account, we will anonymize or delete your personal identifiers within 30 days, but anonymized training data derived from your interactions may be retained.

9. Security

We use reasonable technical and organizational measures to protect your information, including encryption in transit (TLS) and at rest, row-level security in our database, and access controls. However, no system is 100% secure. You use the Services at your own risk. You are responsible for protecting your account credentials. Report any suspected unauthorized access to connect@billowai.net promptly.

10. Subscription Billing & Payments

The Services include paid features subject to the following terms:

  • Founding Member Pricing: The first 100 business registrations per city who join during the founding access period are granted free access to the Services at $0/month for as long as they maintain an active account. This pricing is a promotional benefit and may be revoked if the account violates these Terms or remains inactive for more than 12 consecutive months.
  • Standard Subscription: Business accounts beyond the founding allocation are billed at the then-current monthly rate (currently $29.99/month, subject to change with 30 days' notice). Subscriptions are billed monthly in advance via PayPal. By subscribing, you authorize recurring charges to your PayPal account.
  • Credits: AI feature usage (e.g., announcement generation, image generation, geo ad activation) is powered by in-app credits. Credits are purchased separately and are non-refundable once purchased. Unused credits do not expire but have no cash value and are forfeited upon account termination.
  • Geo Ad Daily Charges: Active geo ads consume 1 credit per day automatically. Ensure your wallet balance is sufficient. We are not responsible for interrupted ad delivery due to insufficient credits.
  • Cancellation: You may cancel your subscription at any time through your PayPal account or by contacting us at connect@billowai.net. Cancellation takes effect at the end of the current billing period. No prorated refunds are issued for mid-period cancellations.
  • Refunds: All payments are final unless required otherwise by applicable law. We do not issue refunds for unused subscription periods or purchased credits, except where required by law (including Apple App Store and Google Play Store refund policies, which govern purchases made through those platforms).
  • Price Changes: We reserve the right to change subscription pricing at any time with at least 30 days' written notice by email or in-app notification. Continued use after a price change constitutes acceptance.
  • Taxes: Prices shown do not include applicable taxes. You are responsible for all taxes associated with your purchase.

11. Children's Privacy

The Services are not directed to children under the age of 13 (or the applicable minimum age in your jurisdiction). We do not knowingly collect personal information from children. If we become aware that we have done so, we will delete such information promptly.

12. Your Rights & Choices

Depending on your location, you may have rights regarding your personal data, including access, correction, deletion, or portability. To exercise these rights, contact connect@billowai.net. We will respond within the timeframe required by applicable law.

  • California Residents (CCPA/CPRA): You may have rights of access, deletion, correction, and the right to opt out of the "sale or sharing" of your personal information. To opt out, contact us at the email above or use the in-app settings.
  • Account Deletion: You may request account deletion in-app or via email. Personal identifiers will be removed within 30 days. See Section 8 for data retention details.

13. International Data Transfers

Billow uses global cloud infrastructure. Your data may be stored and processed in the United States and other countries that may not offer the same level of data protection as your home jurisdiction. By using the Services, you expressly consent to the transfer, storage, and processing of your data outside your home country. Where required by law, we implement appropriate safeguards (e.g., Standard Contractual Clauses) for such transfers.

14. Third-Party Links & Integrations

Our Services may contain links to or integrations with third-party websites, apps, or services (e.g., Google Maps, Apple Maps, PayPal, Vapi.ai, Twilio). These services are operated by third parties under their own privacy policies. We are not responsible for the data practices of any third party. We encourage you to review their privacy policies before providing them with personal information.

15. Public Business Profiles & Your Slug

When you register a business on Billow, a permanent public profile is created at billow.app/pro/your-slug. This profile, including your business name, services, pricing, trust score, reviews, and portfolio images, is publicly accessible and indexed by search engines and AI platforms (including ChatGPT, Google Gemini, and Perplexity). You are responsible for ensuring the accuracy of information on your public profile. Fanattik Tech Labs LLC is not responsible for how third-party AI platforms index, cite, or present information derived from your public profile.

16. User Responsibility for Shared Content

You agree to share only information that you have the right to share. You must not upload, post, or share sensitive personal information, including government-issued IDs, financial account numbers, passwords, private addresses, medical information, or confidential personal data. Billow is not responsible for any consequences resulting from information you voluntarily share publicly or semi-publicly through the Services.

17. Changes to This Policy

We may update this Privacy Policy from time to time. We will post material changes with a new "Last Updated" date. Your continued use of the Services after such changes constitutes your acceptance of the updated Policy. If changes are material, we will provide additional notice (e.g., email or in-app notification) where feasible.
